Los enviados a la cárcel por tres meses son el sargento Librado Recio Solís y el cabo, Rafael de Jesús Díaz Gómez, quienes deberán cumplir el período coercitivo en la Cárcel Modelo de Mao.
Los representantes del Ministerio Público habían solicitado un año de prisión contra los policías sospechosos de haber dado muerte al oficial de manera deliberada.
Los agentes policiales han alegado que dispararon contra el teniente coronel tras la presunta negativa del oficial a acatar una orden de los patrulleros en el horario del toque de queda.
En su defensa los implicados han alegado que el oficial manipuló un fusil M16 cuando se le ordenó detenerse.
Este lunes 28 de diciembre mientras se conocía la coerción se puso a circular un vídeo, de parte de fuentes no identificadas, en el cual supuestamente aparece el teniente coronel Rodríguez Cruz al momento de manipular un arma, de inmediato se escuchan los disparos que se atribuyen a los agentes policiales y el oficial cae herido.
